Tees and Hartlepool Maintenance Dredge Disposal

Dear Tim

Thank you for the opportunity to comment on the potential impact of the above proposed works on the interests of navigation.

The proposal has been examined by staff of the Navigation Safety Branch and it can be noted that the works are unlikely to have an adverse impact, with regards to safety of navigation, provided all maritime safety legislation is followed and:
	* The Consent Holder should ensure suitable bunding, storage facilities are employed to prevent the release of fuel oils, lubricating fluids associated with the plant and equipment into the marine environment.
	* The site is within port limits and the applicant should gain the approval/agreement of the responsible local navigation authority or the Harbour Authority/Commissioners/Council. They may wish to issue local warnings to alert those navigating in the vicinity to the presence of the works, as deemed necessary.
	* If in the opinion of the Secretary of State the assistance of a Government Department, including the broadcast of navigational warnings, is required in connection with the works or to deal with any emergency arising from the failure to mark and light the works as required by the consent or to maintain the works in good order or from the drifting or wreck of the works, the owner of the works shall be liable for any expense incurred in securing such assistance

If these conditions are met I am able to advise you that the Maritime and Coastguard Agency (MCA) has no objection to consent being granted provided that measures are also taken to ensure that details of the proposed works are promulgated to maritime users through notice to mariners and/or navigational warnings.

Please note, however, that a charge will be levied on the developers where appropriate, by MCA, for the transmission of maritime safety information, via Navtex or Coastguard VHF radio network, in respect of the proposed works. Agreement by the developers to pay any such charges should, ideally, be a condition of the consent if they are likely to be used.

-Local potting and trawling vessels operate from surrounding area Hartlepool and Redcar. I would not anticipate any of the activities proposed in this application to negatively impact the local fishing industry as all dredged material is deposited at agreed spoil grounds known to the fishing industry.

-There are many surrounding sensitive areas and Marine protected areas, I would recommend consulting with the Marine Management organisations Marine Conservation and Enforcement team to minimise impact on these areas.

-As the proposed work coincides with freshwater fish migrations I recommend some consultation with the Environment Agency in an effort to minimise impact on these species.

Application: Tees and Hartlepool Maintenance Dredge Disposal MLA/2015/00088

Thank you for your consultation dated 23/10/2015 regarding the above proposal. As there are several designated sites potentially affected by the proposal which are subject to different legislation, my response is differentiated accordingly.

**Marine and Coastal Access Act 2009**

The works as set out in the information supplied by the applicant are not sited within or near to a Marine Conservation Zone. Natural England has not identified a pathway by which impacts from the development would affect the interest features of such a site. We are therefore confident that the works will not hinder the conservation objectives of such a site.

**The Conservation of Habitats and Species Regulations 2010(as amended) and The offshore Marine Conservation (Natural Habitats,& c.) Regulations 2007 (as amended)**

We can confirm that the proposed works are located near to or within the Teesmouth and Cleveland Coast SPA and Ramsar site.

Natural England advises that providing the works are carried out in strict accordance with the details of the application which have been submitted, it can be excluded that the application will have a significant effect on any SAC, SPA or Ramsar site, either individually or in combination with other plans or projects. Therefore it is our view that an Appropriate Assessment of the implications of this proposal on the site's conservation objectives will not be required.
	* We have made this assessment based on the understanding the details in the application and the Maintenance Dredging Baseline Document will be followed and any significant departure from the application or Baseline Document will be notified to Natural England. We have noted it is now a ten year licence so any major changes would be compounded over a ten year period.
	* Cefas guidelines on the disposal of sediment to sea should be adhered to in order to avoid pollutants entering the Marine environment.
	* It is the assumption of Natural England that we will be consulted on any Significant Capital Dredges which are in addition to the maintenance dredging of this application.

**Wildlife and Countryside Act 1981 (as amended)**

We can confirm that the proposed works are located close to or within the Tees and Hartlepool Foreshore and Wetland SSSI, Seal Sands SSSI, Coatham Sands SSSI. Natural England advises that the proposal, if undertaken in strict accordance with the details submitted, is not likely to damage the interest features for which the site has been notified. However this advice is given on the assumption that the activity is undertaken as per the application (see bullet points above for specific relevant aspects of the proposal) and therefore compliant with the above legislation.

Should the application change, or if the applicant submits further information relating to the predicted impacts of this proposal on the designated sites we will provide further advice as appropriate.

If the MMO is minded to grant permission for this application contrary to the advice relating to the Tees and Hartlepool Maintenance Dredge Disposal contained in this letter, we refer you to Section28l (6) of the Wildlife and Countryside Act 1981 (as amended), specifically the duty placed upon the MMO, requiring that you;

Provide notice to Natural England of the permission, and of its terms. This notice should include a statement of how (if at all) the MMO has taken account of Natural England's advice; and
